The scientific article is devoted to the study of the identified vectors of improving the observance of human rights during the application of administrative detention by the police at this stage of the development of Ukrainian statehood. The following vectors for improving the observance of human rights during the application of administrative detention by the police have been identified: the introduction of electronic tools; normative regulation of the procedure for applying administrative detention; improvement of the procedure for appealing administrative detention; normative regulation of the procedure of administrative detention during the establishment of quarantine; legislative consolidation of requirements for the administrative detention protocol. It is proposed to introduce the following electronic tools during administrative detention: electronic digital signature, electronic protocol on administrative detention, entering information about the application of administrative detention to a person in the single portal of state services “Diya”. It is emphasized that there is no normative regulation of the procedure for applying administrative detention in case of committing an administrative offense, the subject of which is a legal entity. It is proposed to enshrine the right to challenge administrative detention in Article 261 of the Code of Ukraine on administrative offenses, as well as to additionally duplicate this right in the protocol on administrative detention. Attention is focused on the need to grant the right to an illegally detained person to claim compensation for damages. It is proposed to expand the list of grounds for detaining persons by the police under the conditions of the introduction of quarantine. It is proposed to additionally determine the requirements for protocols in proceedings in cases of administrative offenses in the norms of the Code of Ukraine on administrative offenses. The author notes that the legislation does not provide for additional grounds for administrative detention under martial law, such grounds are general. In addition, it was emphasized that there is no special procedure for administrative detention during martial law. It was concluded that the application of administrative detention, in particular, is a dynamic process that must comply with the principle of legality, the requirements of society’s development, standards of compliance with human rights, and other external factors.

Наукову статтю присвячено дослідженню ви­значенихвекторів удосконалення дотримання прав людини під час застосування адміністра­тивного затримання поліцейськими на даному етапі розвитку української державності. Виді­ленотакі вектори удосконалення дотримання прав людини під час застосування адміністра­тивного затримання поліцейськими: запро­вадження електронних інструментаріїв; нор­мативна регламентація порядку застосування адміністративного затримання; удосконалення порядку оскарження адміністративного затри­мання; нормативна регламентація порядку ад­міністративного затримання під час встановлен­ня карантину; законодавче закріплення вимог до протоколу про адміністративне затримання. Запропоновано запровадження таких електро­нних інструментаріїв під час здійснення адмі­ністративного затримання: електронний циф­ровий підпис, електронний протокол про адмі­ністративне затримання, внесення відомостей про застосування адміністративного затримання до особи до єдиного порталу державних послуг «Дія». Наголошено на відсутності нормативної регламентації порядку застосування адміністра­тивного затримання у випадку вчинення адміні­стративного правопорушення, суб’єктом якого є юридична особа. Запропоновано закріпити пра­во на оскарження адміністративного затриман­ня у статті 261 КУпАП, а також додатково про­дублювати це право у протоколі про адміністра­тивне затримання. Акцентовано увагу на необ­хідності надання права незаконно затриманій особі вимагати відшкодування збитків. Запро­поновано розшити перелік підстав затримання осіб поліцейськими в умовах запровадження ка­рантину. Запропоновано додатково визначити вимоги до протоколів у провадженні в справах про адміністративні правопорушення в нормах КУпАП. Автор зауважує, що додаткових підстав здійснити адміністративне затримання в умовах дії воєнного стану законодавством не перед­бачено,такі підстави є загальними. Крім того, наголошено, що не існує особливого порядку здійснення адміністративного затримання під час дії воєнного стану. Зроблено висновок про те, що застосування адміністративного затри­мання зокрема - це динамічний процес, який має відповідати принципу законності, вимогам розвитку суспільства, стандартам дотримання прав людини та іншим зовнішнім факторам.
