THE CLASSIFICATION OF BYLAW NORMATIVE LEGAL ACTS

Abstract

Исследуются взгляды ученых по разделению подзаконных нормативно-правовых актов на группы исходя из избранных критериев. Обращается внимание на новеллы в их классификации. Выделяются положительные наработки ученых, которые будут способствовать совершенствованию правоприменения подзаконных нормативно-правовых актов. Сделан вывод о наибольших противоречиях ученых о формулировках критериев, по которым осуществляется классификация нормативно-правовых актов. Ключевые слова: подзаконные нормативно-правовые акты, классификация, критерии определения, общественные отношения, субъекты правотворчества.

The views of scientists on the division of by regulatory legal acts into groups according to selected criteria are investigated. The attention is paid to novels in their classification. The positive experience of scientists which will contribute to the improvement of regulatory enforcement of regulations are focused. The conclusion of the greatest contradictions of scientists to formulate criteria for the classification of normative legal acts is done. Key words: bylaw regulatory legal acts, classification criteria definition, public relations, law-making entities.

Досліджуються погляди науковців щодо поділу підзаконних нормативно-правових актів на групи за обраними критеріями. Звертається увага на новели в їх класифікації. Виділяються позитивні напрацювання науковців, які будуть сприяти удосконаленню правозастосування підзаконних нормативно-правових актів. Зроблений висновок про найбільші суперечності науковців щодо формулювання критеріїв, за якими здійснюється класифікація нормативно-правових актів.
