THE TREATY AND LEGAL RELATIONS OF UKRAINE WITH THE SUBJECTS OF FOREIGN FEDERAL STATES

Abstract

The article considers the limited practice of Ukraine’s conclusion of international legal agreements with the subjects of federal states. The treaties mainly concluded of the powers of individual ministries. On the example of the Agreement between Ukraine and the Republic of Tatarstan, the legal procedure for concluding such a treaty and the applicable norms of international law have been clarified, legal conditions for its implementation have been examined,which confirm membership in international public law treaties.

В статье частично рассмотрена практика заключения Украиной международно-правовых договоров с субъектами федеративных государств. Договоры заключались преимущественно в сфере полномочий отдельных министерств. На примере Соглашения между Украиной и Республикой Татарстан проанализирована правовая процедура заключения такого договора и применение норм международного права, исследованы правовые условия его реализации, которые подтверждают принадлежность к международным договорам публичного права.

У статті розглянута поодинока практика укладання Україною міжнародно-правових договорів з суб’єктами федеративних держав. Договори укладалися переважно в сфері повноважень окремих міністерств. На прикладі Угоди між Україною і Республікою Татарстан з’ясована правова процедура укладання такого договору та застосовані норми міжнародного права, досліджені правові умови його реалізації, що підтверджують належність до міжнародних договорів публічного права.
