The article investigates the social, economic and regulatory factors establishing criminal responsibility for attacks on cultural values.Socio-economic factors to establish criminal liability for acts under Art. 298 of the Criminal Code of Ukraine expressed the need for social and political expediency of establishing such liability. Archaeological and cultural heritage plays an important role in society. It affects the development of science, art, economy and other spheres of social life. But the preservation and maintenance of the monuments of culture and architecture society requires constant attention and considerable resources.Regulatory factors establishing criminal responsibility for attacks on cultural values represent a system of legal acts regulating social relations in the sphere of archaeological and cultural heritage. The main such regulations is the Constitution of Ukraine, international treaties ratified by the Parliament of Ukraine and laws of Ukraine in the field of cultural values.

Исследуются социально-экономические и нормативные факторы установления уголовной ответственности за незаконное проведение поисковых работ на объекте археологического наследия, уничтожение, разрушение или повреждение объектов культурного наследия. Анализируются международные и национальные нормативно-правовые акты в сфере охраны культурных ценностей.

Досліджено соціально-економічні та нормативні фактори встановлення кримінальної відповідальності за незаконне проведення пошукових робіт на об’єкті археологічної спадщини, знищення, руйнування або пошкодження об’єктів культурної спадщини. Проаналізовано міжнародні та національні нормативно-правові акти у сфері охорони культурних цінностей.
