CURRENT ISSUES OF LAND DEVELOPMENT IN COMMUNITIES AND DEFENSIVE RESILIENCE OF UKRAINE

Abstract

The paper addresses the pressing issues and challenges of land relations in Ukraine, emphasizing the urgent need to redefine priorities for land management and development during the wartime period. It highlights that the ongoing war and military aggression in Ukraine have intensified the necessity for improving land relations, revising land policies, and incorporating best practices and expertise from European and global countries. However, it stresses the importance of adapting these strategies to Ukraine's unique conditions and cautions against excessive liberalization, which could lead to negative consequences.Special attention is given to fostering social justice in the redistribution of land. This includes ending the practice of free privatization, placing stricter limits on the concentration of land ownership by a single entity, and preventing the auction-based redistribution of natural grazing lands, community pastures, and gardens. The document also underscores the importance of ensuring an equitable allocation of land rent to benefit local communities and stakeholders.In terms of spatial development, the paper points to the critical need for enhancing administrative-territorial structures, revising the General Plan of Ukraine, updating state construction norms, and promoting balanced rurbanization policies to achieve sustainable development. Additionally, the text explores the necessity of expanding defense lands and implementing specialized land management systems within the border strip and the 100-kilometer border zone, reflecting the current geopolitical challenges.Finally, it concludes that revitalizing agricultural, forest, and water fund lands, especially in regions affected by the war, will require substantial efforts, comprehensive international support, and significant regulatory reforms in land management and cadastral policies to ensure sustainable recovery and development.

У роботі розглянуто актуальні питання та проблеми земельних відносин в Україні, визначено пріоритети землеустрою та земельного розвитку на період війни. Визначено посилення соціальної справедливості в перерозподілі земель, припиненні безоплатної приватизації, обмеження скуповування земель в одні руки, недопущення аукціонного перерозподілу природних кормових угідь і громадських пасовищ і городів, формування справедливого перерозподілу земельної ренти. Зазначено про необхідність подальшого вдосконалення адміністративно-територіального устрою, Генеральної схеми України, державних будівельних норм, політики рурбанізації. Розглянуто необхідність розширення земель оборони та особливий землеустрій прикордонної смуги і стокілометрової прикордонної зони. Визначено, що ревіталізація земель сільськогосподарських, лісового і водного фонду забудованих територій в умовах великих площ белігеративних ландшафтів, сформованих війною, потребує зусиль і допомоги світового співтовариства та кардинальної зміни регуляторної політики у сфері землеустрою і земельного кадастру.
