The article is devoted to a popular topic, namely: research into the history of development, formation and prospects of administrative justice in Ukraine. It is established that Ukraine acts as a legal and democratic state, which at the legislative level recognizes the provision of a person and a citizen with a minimum package of rights and freedoms in the form of one of its duties. We have identified the periods that belong to the prerequisites for the further emergence of the administrative process and also conducted their detailed analysis. The specified group includes the time period of the existence of Kyivan Rus, the Cossack and Lithuanian-Polish eras, where the latter is included only partially, namely: until the 16th century. It is found out about the beginning of the fundamental formation of administrative justice in modern Ukrainian territories in the second part of the Lithuanian-Polish era, that is, from the 16th-17th centuries. Further, the formation of administrative justice, which took place continuously in the pre-Soviet era, and provided for a division into four eras, is covered. The important conclusions were the determination of a faster process of its formation in the Ukrainian territories within the Austro-Hungarian Empire than in the Russian, although such state formations existed almost at the same time. In addition, the significant contributions to the establishment of administrative justice during the Ukrainian Revolution of 1917-1921 were emphasized. However, the described achievements were destroyed during the stage of the Soviet Union, which completely eliminated the existence of this institution. The state of administrative justice in independent Ukraine, which is divided into two periods: formation and development (1991-2005) and since 2005, is also studied.it is about the formation and development of this institution, and the reasons for such a division are also clarified. Finally, the international experience of countries is considered. Taking into account the proximity to other states according to one or another criterion, the experience of France and Germany in this regard is analyzed, where the latter turned out to be the most similar to the domestic model and appropriate for implementation by our state. As a conclusion, it is generalized that administrative justice in Ukraine is quite perfect, and therefore has a sufficient degree of prospect of complying with the norms of the European Union without resorting to radical changes in the domestic model of administrative justice.

Стаття присвячена затребуваній темі, а саме: дослідження історії розвитку, становленню та перспектива адміністративної юстиції в Україні. Встановлено, що Україна виступає як правова й демократична держава, котра на законодавчому рівні визнає надання людині та громадянину мінімального пакету прав і свобод у формі одного з її обов’язків. Нами було визначено періоди, які належать до передумов подальшого виникнення адміністративного процесу, а також проведено їх детальний аналіз. До зазначеної групи входить часовий проміжок існування Київської Русі, Козацької й литовсько-польської діб, де останню включено лише частково, а саме: до XVI століття. З’ясовано про початок фундаментального утворення адміністративної юстиції на сучасних українських територіях у другій частині литовсько-польської доби, тобто з XVI-XVII століть. Надалі охоплено становлення адміністративної юстиції, котре безперервно відбувалось у дорадянській добі, і передбачало поділ на чотири доби. Вагомими висновками було визначення швидшого процесу її становлення на українських територіях у складі Австро-Угорській імперії, аніж у Російської, хоч такі державні утворення існували майже в ідентичний час. Крім того, наголошено на вагомих внесках для затвердження адміністративної юстиції під час Української революції 1917-1921 рр. Втім, описані здобутки були зруйнованими під час етапу Радянського Союзу, який повною мірою нівелював існування даного інституту. Також досліджено становище адміністративної юстиції в незалежній Україні, котрий поділено на два періоди: становлення й розвиток (1991-2005 рр.) і з 2005 р. мова йде про формування та розвиток цього інституту, а також з’ясовано причини такого поділу. Наостанок, розглянуто міжнародний досвід країн. Беручи до уваги наближеність до інших держав за тим чи іншим критерієм, проаналізовано досвід Франції й Німеччини з цього приводу, де остання виявилась найбільш схожою до вітчизняної моделі й доцільною до імплементації нашою державою. У якості висновку узагальнено, що адміністративна юстиція в Україні є доволі доконаною, а тому має достатню міру перспективи відповідати нормам Європейського Союзу без перебігу до докорінних змін вітчизняної моделі адміністративного судочинства.
