Abstract

On the basis of the analysis of the labor legislation the conclusion is made about existence in it of contradictions, gaps and collisions that leads to lack of uniformity in law enforcement practice. Based on the results of their own specific sociological research identified four problems of social and legal nature. Based on the analysis of these problems, it was revealed that three of them have the necessary legislative regulation, however, this is not enough for an effective comprehensive solution to the issue of employment of persons with disabilities. The problem of the lack of effective inclusive interaction between all participants of labor relations is to date little studied, and one of the most unresolved. As practice has shown, the prerequisite for solving the problem of inclusive interaction is the observance by all participants of labor relations of the simplest rules of in-clusive interaction. This method has a different degree of relevance and effectiveness for different nosological groups. The article also describes the positive effects that can be achieved by applying this method.

На основе анализа трудового законодательства делается вывод о наличии в нем противоречий, пробелов и коллизий, что приводит к отсутствию единообразия в правоприменительной практике. На оснвании результатов собственного конкретного социологического исследования выделены четыре проблемы социально правового характера. На основе анализа указанных проблем выявлено, что три из них имеют необходимое законодательное урегулирование, однако, этого не достаточно для эффективного комплексного решения вопроса трудовой занятости лиц с инвалидностью. Проблема отсутствия эффективного инклюзивного взаимодействия между всеми участниками трудовых правоотношений является на сегодняшний день мало изученной, и одной из самой не урегулированных. Как показала практика, предпосылкой решения проблемы инклюзивного взаимодействия является соблюдение всеми участниками трудовых отношений простейших правил инклюзивного взаимодействия. Данный метод имеет разную степень актуальности и эффективности для различных нозологических групп. Так же в статье описаны положительные эффекты, которых можно достичь, применяя указанный метод.
