The article considers some arguable aspects of the theoretical and methodological problems historicolegal studies. The author concludes about the existence of certain gnoseological differences between the historico-juridical studies and universal historic range of problems: the history of state and law is a legal subject, focusing on the study not of the people in time but rather legal and political systems of the past. The realization of the normative approach towards the study of legislative sources is imposed by the practical tasks of legal science, which makes the author question the possibility of free application of combined methods of research by historians studying law.

Рассматриваются дискуссионные аспекты теоретико-методологических проблем историко-правовой науки. Автор приходит к выводу о наличии существенных гносеологических различий между историко-юридическими исследованиями и общеисторической проблематикой: история государства и права — юридическая дисциплина, объектом исследования которой являются не «люди во времени», а правовые и политические системы прошлого. Актуализация нормативного похода к изучению законодательных источников продиктована практическими задачами правоведения, что ставит под вопрос возможность свободного обращения историков-юристов к синтезным методам научного исследования.
