Abstract

El esfuerzo de hacer emerger el trabajo sumergido o informal, es advertido como prioritario a escala mundial. Éste encuentra estímulo en las cargas económicas que recaen sobre la producción y en una parcial intervención para la tutela. El derecho del trabajo debe colmar a través de todo género de intervenciones, el déficit de protección social. Se indaga si el derecho del trabajo puede conservar sus connotaciones sustanciales o más aún, debe diseñarse un derecho social más vasto que el laboral. Se examina además las estrategias llevadas a cabo, principalmente en Italia y la Unión Europea. The effort to bring out submerged or informal work is considered a priority on a world scale. Stimulus for this effort can be found in the economic burdens that fall to production and in partial intervention for protection. The right to work should be fulfilled through all types of interventions, the deficit of social protection. This work investigates whether the right to work can conserve its substantial connotations or even more, whether a social right greater than the right to work should be designed. Furthermore, the strategies applied, principally in Italy and the European Union, are examined.
