Об отраслевой принадлежности института лицензирования

Abstract

Гвоздев, Д. В. Об отраслевой принадлежности института лицензирования / Д. В. Гвоздев // Вестник Академии МВД Республики Беларусь. - 2009. - № 1. - С. 84 - 87. Исследуются проблемы отраслевой принадлежности института лицензирования. Анализируются положения декрета президента Республики Беларусь «О лицензировании отдельных видов деятельности», Гражданского кодекса Республики Беларусь, мнения различных исследователей по данной проблеме. Рассматривается влияние, которое оказывает выдача специального разрешения (лицензии), приостановление ее действия или аннулирование лицензии на гражданскую правосубъектность юридического лица. Определяются предмет и метод правового регулирования института лицензирования. Исходя из этого делается вывод о принадлежности института лицензирования к отрасли административного права.
