Исследуется возможность применения банковской гарантии в налоговых правоотношениях Республики Беларусь как перспективного способа обеспечения исполнения налогового обязательства. Рассматриваются доктринальные подходы к определению ее правовой природы и сущности в области гражданского и налогового права. Аргументирована необходимость внедрения в систему способов обеспечения исполнения налогового обязательства наряду с залогом и поручительством банковской гарантии путем внесения необходимых изменений и дополнений в Налоговый кодекс Республики Беларусь. = The paper investigates the possibility of a bank guarantee in tax legal relations of the Republic of Belarus as a promising method of enforcement of the tax liability. Considered doctrinal approaches to the definition of its legal nature and essence of civil and tax law, on the basis of which the author comes to the conclusion that it is a publiclaw nature of the legal relationship of fiscal. The necessity of introducing a system of ways to ensure the fulfillment of tax obligations, along with a guarantee and surety, bank guarantees by making the necessary changes and additions to the Tax code of the Republic of Belarus.
