Исследованы особенности правового регулирования и порядок применения мер поощрения и взыскания к осужденным к ограничению свободы без направления в исправительное учреждение открытого типа. Проанализирован порядок представления осужденных к условно-досрочному освобождению и замене неотбытой части наказания более мягким. Выявлены недостатки правового регулирования порядка установления степеней исправления исследуемого типа осужденных. Предложены основные направления совершенствования уголовно-исполнительного законодательства Республики Беларусь. = Features of legal regulation and an order of application of measures of encouragement and collecting to convicts to restriction of freedom without the direction in correctional facility of open type are investigated. The order of representation of convicts to parole and replacement to not left part of punishment to softer is analysed. Shortcomings of legal regulation of an order of establishment of extents of correction of convicts to punishment in the form of restriction of freedom without the direction in correctional facility of open type are revealed. The main directions of improvement of the criminal and executive legislation of Republic of Belarus in scope of application to convicts of measures of encouragement and collecting who will allow to execute this punishment most effectively are offered.
