Le sujet du droit à la citoyenneté est sans aucun doute assez vaste et ses recherches prennent de lrsquo;ampleur, car de plus en plus de théoriciens discutent de la manière dont de nombreuses crises influencent le concept de citoyenneté. La citoyenneté est un principe qui constitue la source du lien juridico-politique entre lrsquo;État et le citoyen, en même temps, le concept srsquo;évalue à mesure que les États évoluent et se développent. Dans cet article, lrsquo;institution de la citoyenneté en tant que notion de droit sera étudiée. Subiectul privind dreptul la cetăţenie este, fără îndoială, destul de vast şi cercetarea acestuia ia amploare, pe măsură ce tot mai mulţi teoreticieni iau în discuţie modalităţile în care numeroase crize influenţează conceptul de cetăţenie. Cetăţenia reprezintă un principiu care constituie sursa legăturii juridico-politice între stat şi cetăţean, în acelaşi timp, conceptul evaluează pe măsură ce evoluează şi se dezvoltă statele. În articolul respectiv se va cerceta instituția cetățeniei ca noțiune de drept. Caracterul specific al acestei instituții se explică prin faptul că aceasta integrează elemente proprii mai multor ramuri de drept. Noțiunea juridică de cetățenie rezultă cu preponderență din dreptul constituțional, deoarece este expresia suveranității și anume acest drept determină conținutul propriu-zis al acestei instituții. Scopul și obiectivele articolului, constituie reflectarea instituției dreptului la cetățenie, a garanțiilor și limitelor acesteia, ca elemente ale dreptului constituțional, cu supunerea unei expertize de compatibilitate a limitelor constituționale naționale cu cele internaționale în domeniul protecției dreptului la cetățenie cu normele Convenției CEDO și jurisprudența CtEDO, argumentarea unor schimbări în vederea ajustării normelor naționale la cele internaționale.

Citizenship is a principle that is the source of the legal-political link between the state and the citizen, at the same time, the concept evaluates as it evolves and develops states. That article will examine the institution of citizenship as a notion of law. The specific nature of this institution is explained by the fact that it integrates elements specific to several branches of law. The legal notion of citizenship results mainly from constitutional law, because it is the expression of sovereignty, namely this right determines the actual content of this institution. The purpose and objectives of the article are to reflect the institution of the right to citizenship, its guarantees and limits, as elements of constitutional law, subject to expertise the compatibility of national and international constitutional limits in the field of protection of the right to citizenship with the rules of the ECHR Convention and the case law of the EctHR,to argue for changes in order to adjust national to international ones.

Цель и задачи статьи заключаются в том, чтобы отразить институт права на гражданство, его гарантии и ограничения, как элементы конституционного права, подвергнув экспертизе совместимость национальных и международных конституционных ограничений в сфере защиты права на гражданство с нормами Конвенции ЕСПЧ, аргументируя изменения для корректировки национальных и международных правил.
