Chiar dacă prin activitatea infracțională care din anumite circumstanțe nu și-a atins scopul dorit și prevăzut de făptuitor, infracțiunea nu va fi considerată consumată, acest fapt nu-l eliberează de la răspunderea penală pe făptuitor. Organul de urmărire penală în procesul de investigare al tentativei de infracțiune urmează să stabilească toate circumstanțele ce au legătură cu faptul investigat, în vederea oferirii unei calificări corecte și aplicării pedespei corespunzătoare pentru infracțiunea neconsumată.
