Lrsquo;essence de lrsquo;assistance juridique gratuite est formée par un système de relations publiques résultant de lrsquo;appel de certaines personnes par la loi à lrsquo;organe habilité auprès des fonctionnaires afin de recevoir gratuitement une assistance juridique qualifiée. Des éléments importants du concept d lsquo; ldquo;assistance juridique gratuiterdquo; constituent la base et la procédure de son octroi, ce qui conduit à son tour à la nécessité de déterminer dans la législation les personnes ayant droit à une assistance juridique gratuite. En République de Moldova, un grand nombre de personnes reçoivent drsquo;année en année une assistance juridique gratuite, payée par lrsquo;État. Dans le même temps, le droit à une assistance juridique gratuite nrsquo;est pas absolu et la possibilité drsquo;obtenir une telle aide est une garantie supplémentaire drsquo;accès à la justice pour les personnes socialement vulnérables. Dans cet article, lrsquo;auteur examine les critères internationaux pour la fourniture drsquo;une assistance juridique garantie par lrsquo;État afin de trouver un équilibre entre le principe de la disponibilité drsquo;une assistance juridique gratuite et lrsquo;efficacité de lrsquo;utilisation des fonds publics qui lui sont alloués.

Esența asistenței juridice gratuite este formată dintr-un sistem de relații publice care decurge din adresarea unor persoane, stabilite prin lege, la organul împuternicit la funcționari pentru a primi gratuit asistență juridică calificată. Elemente importante ale conceptului de bdquo;asistență juridică gratuitărdquo; stau la baza și procedura acordării acesteia, ceea ce duce la rândul său la necesitatea determinării în legislație a persoanelor îndreptățite la asistență juridică gratuită. În Republica Moldova, un număr mare de persoane de la an la an primesc asistență juridică gratuită, plătită din contul statului. Totodată, dreptul la asistență juridică gratuită nu este absolut, iar posibilitatea de a obține un astfel de ajutor reprezintă o garanție suplimentară a accesului la justiție pentru persoanele social vulnerabile. În prezentul articol, autorul examinează criteriile internaționale de acordare a asistenței juridice garantate de stat pentru a găsi un echilibru între principiul disponibilității asistenței juridice gratuite și eficacitatea utilizării fondurilor publice alocate pentru aceasta.

Сущность бесплатной юридической помощи образует система общественных отношений, возникающих в результате обращения определенных законом лиц в уполномоченный орган к должностным лицам с целью получения квалифицированной юридической помощи на бесплатной основе. Важными элементами понятия laquo;бесплатная юридическая помощьraquo; являются основание и порядок ее предоставления, что, в свою очередь, приводит к необходимости определения в законодательстве лиц, имеющих право на бесплатную юридическую помощь. В Республике Молдова большое количество людей из года в год получает бесплатную юридическую помощь, оплачиваемую государством. При этом право на бесплатную юридическую помощь не является абсолютным, а возможность получения такой помощи является дополнительной гарантией доступа к правосудию для социально не защищенных лиц. В данной статье автор исследует международные критерии предоставления юридической помощи, гарантируемой государством, с целью нахождения баланса между принципом доступности бесплатной юридической помощи и эффективности использования выделяемых на нее государственных средств.

The essence of free legal aid consists of a public relations system that results from the appeal of some persons by law to the body empowered to officials to receive free qualified legal aid. Important elements of the concept of ldquo;free legal aidrdquo; are the basis and procedure for granting it, which in turn leads to the need to determine in law the persons entitled to free legal aid. In the Republic of Moldova, a large number of people from year to year receive free legal assistance, paid by the state. At the same time, the right to free legal aid is not absolute, and the possibility of obtaining such aid is an additional guarantee of access to justice for socially vulnerable people. In this article, the author examines the international criteria for granting state-guaranteed legal aid in order to find a balance between the principle of the availability of free legal aid and the effectiveness of the use of public funds allocated to it.
