Abstract

Концепция С.А. Муромцева выстроена на истории и догме римского права, критике гегельянства, исторической школы права, идеях Р. Иеринга с упором на англо-французский позитивизм. Охарактеризовно становление методологии Муромцева, ее источники и составные элементы, влияние на определение предмета, задачи правовой науки и ее разделение на отрасли. Делается вывод, что заслуга С.А. Муромцева – не «изобретение» новой методологии, а применение позитивизма к исследованию права.
