Уголовная ответственность за нарушение режима конфиденциальности в российском и зарубежном законодательстве

Abstract

Исследованы состояние и перспективы уголовной ответственности за нарушения режима конфиденциальности охраняемой тайны на основе возможных неправомерных действий. Сделаны выводы о несоответствии положений уголовного закона России современным вызовам и угрозам, необходимости выделения экономического шпионажа и умышленного разглашения коммерческой тайны в отдельные составы, введения состава, охраняющего персональные данные, возможности декриминализации разглашения тайны усыновления.
