Соседские права как способ обеспечения баланса интересов собственников соседствующей недвижимости

Abstract

Обеспечение баланса интересов является основной целью правового регулирования потенциально конфликтных соседских отношений. Проанализирована дореволюционная история российского соседского права, его современные перспективы, состояние правоприменительной практики по разрешению межсоседских споров. Выявлена роль широко применяемого судами принципа обеспечения баланса интересов собственников соседствующей недвижимости, обоснована необходимость его законодательного закрепления.
