А. Ф. Кистяковский о смертной казни и нравственных основаниях государства

Abstract

Рассматриваются взгляды представителя русской школы философии права А.Ф. Кистяковского на природу смертной казни. Исследуется его идея, что смертная казнь со временем будет полностью отменена государствами в связи с самим «развитием человечества». Выделены спорные моменты такой позиции, позволяющие объяснить причину расхождения общественного сознания и решений государства по вопросу о смертной казни.
