Специализированные суды в контексте дифференциации и интеграции судебных юрисдикций

Abstract

Исследуются место и роль специализированных судов в процессах дифференциации и интеграции судебных юрисдикций, обосновываются критериями их создания. Анализируются виды специализированных судов в странах Европы, приводится их классификация. Выявляются преимущества и недостатки специализированных судов. Обосновывается вывод о том, что специализированные суды должны обладать определенной сферой компетенции и иметь специальное регулирование в рамках трех составляющих механизма правосудия: судоустройственной, судопроизводственной и судейско-статусной.
