Abstract

Право природопользования признается комплексным правовым институтом и различается в объективном и субъективном смыслах. Если общее природопользование осуществляется путем реализации естественного права человека на благоприятную окружающую среду, то специальное природопользование осуществляется в процессе экономической деятельности физических и юридических лиц. Авторами проведен сравнительный анализ законодательства Республики Казахстан, Республики Беларусь и Российской Федерации в сфере природопользования и охраны окружающей среды, выявлены содержательные характеристики и правовая природа ограничений права природопользования, их взаимосвязь с формами собственности на природные ресурсы.
