Mediação de conflitos e voluntariedade: olhares cruzados entre Rio de Janeiro e Buenos Aires

Abstract

O objetivo deste artigo é contrastar a mediação de conflitos no Rio de Janeiro e em Buenos Aires, especialmente no que se refere à consideração da vontade das partes. A partir da observação participante e de conversas e entrevistas com atores sociais envolvidos na mediação de conflitos – seja como mediandos seja como mediadores – demonstra-se que em ambos os campos empíricos a ênfase é colocada na voluntariedade dos mediandos para que a mediação aconteça. No entanto, tanto no Rio de Janeiro como em Buenos Aires, o caráter voluntário de se submeter à mediação é paradoxal posto que no primeiro caso as partes são encaminhadas por um juiz (caso este seja simpático à proposta) no âmbito do processo e no segundo, a mediação pré-judicial é obrigatória, por lei, antes do ingresso no judiciário por meio da abertura de um processo.
