La Aplicación del principio de culpabilidad, en infracciones administrativas de seguridad y salud en el trabajo por SUNAFIL, Perú, 2019

Abstract

En este trabajo, se analiza y verifica la aplicación del Principio de Culpabilidad” por la Superintendencia Nacional de Fiscalización Laboral (SUNAFIL), ante el incumplimiento de las normas de seguridad y salud en el trabajo por parte de los empleadores. Principio que ha sido objeto de reconocimiento por el Tribunal Constitucional en el procedimiento administrativo sancionador peruano, y que ahora se encuentra expresamente en la Ley de Procedimiento Administrativo General, desde diciembre de 2016, como parte de los principios que regulan la potestad sancionadora administrativa. Palabras clave: Ius puniendi, Principio de culpabilidad, potestad sancionadora y seguridad y salud en el trabajo.
