Abstract

O ESTADO DE COISAS INCONSTITUCIONAL AMBIENTALResumo: O Estado de Coisas Inconstitucional (ECI) surge no Supremo Tribunal Federal a partir do julgamento das liminares insertas na Arguição de Descumprimento de Preceito Fundamental (ADPF) nº 347-MC/DF, em novembro de 2015. O presente estudo instiga o diálogo entre juristas acerca da aplicação no Brasil do Estado de Coisas Inconstitucional Ambiental ante as falhas do Estado ao comando constitucional de defensor e protetor do meio ambiente. A inquietação surge a partir da inefetividade das normas ambientais, principalmente pelo Poder Executivo, mas não exclusivamente. As hipóteses do estudo foram investigadas por meio de pesquisa bibliográfica numa abordagem teórico-empírica. Conclui-se que o Estado de Coisas Inconstitucional constitui, num oceano de decisões, uma gotícula representativa do diálogo transnacional. Por se tratar de uma ferramenta de controle, melhor dizendo, um ativismo estrutural para forçar o Poder Executivo a adimplir com as funções que lhe são constitucionalmente atribuídas, ainda é prematura a doutrina brasileira sobre o tema. É prudente um olhar atento sobre o Estado de Coisas Inconstitucional no controle da efetividade da gestão pública ambiental por força do princípio da prevenção inerente ao Direito Ambiental. A história da gestão ambiental brasileira registra o quão padecem Estado e sociedade do empoderamento dos deveres ambientais. Palavras-chaves: Estado de Coisas Inconstitucional Ambiental. Meio Ambiente.STATE OF ENVIRONMENTAL UNCONSTITUTIONAL THINGSAbstract: The Unconstitutional State of Things (ECI) arises in the Federal Supreme Court from the judgement of uncertain injunctions on the claims of non-compliance with a fundamental precept (ADPF) nº 347-MC/DF, in November of 2005. This study instigate the dialogue among legal practitioners about the implementation of the environment unconstitutional state of things before the government failures to the constitutional rules of defender and protector of the environment. The concern began with the infectivity of the environment rules, mainly, by the executive power, but not exclusively. The hypotheses of the study have been investigated by the bibliographic research in a theoretical-empirical approach. It’s concluded that the unconstitutional state of things represents, in a branch of decisions, just one more representative decision among the many others in the transnational dialogue. As it is an a control tool, or to tell in better way, an structural activism created to force the executive power comply with the functions that is in charge by law. It is still premature the Brazilian legal doctrine about this subjective. It’s wise to take a close look about The Unconstitutional state of things and it’s effectivity control in the environment public administration in accordance with the principle of inherent prevention of the environmental law. The history of Brazilian environmental management records how much lack, the state and society, have of the empowerment of environment duties.dogmatic and law theory.
