The thirty-five years of education in the 1988 Constitution

Abstract

This article aims to reiterate the advances brought by the Constitution of the Federative Republic of Brazil, on the occasion of the 35th anniversary of its promulgation in 1988, pointing them out as developments in the education chapter itself and in other articles of the Major Law. The article explains the foundations, objectives and principles of the Magna Carta, the basis of other infra-constitutional laws. Thus, education is a right that is directly related to these foundations of the Greater Law, taking into account the rights of citizenship and human rights. Education is seen both as a principle and a norm of citizenship, affecting nationals and every person permanently in the country. These guidelines also cover the conceptual definition of education, its principles, its norms, the duty of the State, federalism and financing, in addition to governing private education. The continent of the Constitution is democracy in the form of a Democratic State of Law.

Este artigo tem como propósito reiterar os avanços trazidos pela Constituição da República Federativa do Brasil, por ocasião dos 35 anos de sua promulgação em 1988, apontando-os como desdobramentos no capítulo próprio da educação e em outros artigos da Lei Maior. O artigo explicita os fundamentos, os objetivos e os princípios da Carta Magna, base das demais leis infraconstitucionais. Assim, a educação é um direito que se relaciona diretamente com esses fundamentos da Lei Maior, tendo em vista os direitos da cidadania e os direitos humanos. A educação é posta como um princípio e uma norma da cidadania afetando tanto os nacionais, quanto a toda pessoa que esteja, de modo permanente, no País. Tais diretrizes abrangem também a definição conceitual da educação, seus princípios, suas normas, o dever do Estado, o federalismo e o financiamento, além de reger a educação privada. O continente da Constituição é a democracia na conformação de um Estado Democrático de Direito.
