Стаття присвячена аналізу Угоди про санітарні та фітосанітарні заходи СОТ та Глави 4 Розділу IV «Торгівля і питання, пов’язані з торгівлею» Угоди про асоціацію між Україною та ЄС. Автор висвітлює питання співвідношення санітарних та фітосанітарних заходів із технічними регламентами, стандартами та процедурами оцінки відповідності згідно вимог СОТ та ЄС. Зроблено висновок про те, що санітарні та фітосанітарні заходи є окремою групою нетарифних обмежень торгівлі, метою яких є захист життя та здоров’я людей, тварин та рослин від ризиків, пов’язаних із продуктами харчування, хвороботворними організмами та шкідниками, а також попередження інших втрат від шкідників, а мета застосування обмежень виступає головною та єдиною ознакою, яка дозволяє відокремити технічні бар’єри у торгівлі (технічні регламенти, стандарти та процедури оцінки відповідності) від санітарних та фітосанітарних заходів. The article is devoted to the analysis of the Agreement on Sanitary and Phytosanitary Measures of the WTO and Chapter 4 of the Association Agreement between Ukraine and the EU entitled «Trade and Trade-Related Issues». The article considers the problem of the sanitary and phytosanitary measures correlation with the technical regulations, standards and conformity assessment procedure as required by the WTO and the EU. The author argues that in the context of the Agreement on Sanitary and Phytosanitary Measures of the WTO, other WTO agreements, the Association Agreement with the EU, the EU Regulations sanitary and phytosanitary measures should be interpreted as the legal provisions enshrined in laws, regulations, rules, instructions and procedures, including veterinary, quarantine-sanitary and epidemiological requirements for the final product, the production and processing of products, inspection and certification procedures aimed at protecting the life and health of people, animals and plants.
