
The expediency of «privatization» of land under an apartment house and the problem of benefit for owners of residential and non-residential premises are analyzed in the article. The author points out the conflict of laws concerning the legal regulation of fixing the boundaries of such lands. He also draws attention to the absence of clearly defined criteria in the legislation of the subjects of the Russian Federation.
В статье исследуется целесообразность «приватизации» земельного участка под многоквартирным домом, проблема выгоды для собственников жилых и нежилых помещений. Автор отмечает коллизионные аспекты нормативного регулирования в вопросах закрепления границ таких земельных участков и отсутствие четких критериев в законодательстве субъектов Российской Федерации.
