Особенности процесса пересмотра административных актов в административном суде Великобритании

Abstract

Статья посвящена тенденциям развития административного законодательства Великобритании в сфере административного судопроизводства. Автором отмечена оптимизация и унификация административно-процессуальных норм, а также рассмотрены особенности юрисдикционной деятельности административного суда Великобритании. Обосновано наличие формального подхода к процедурам административного судопроизводства в требованиях законодателя Великобритании и выделена специфика понимания административных актов британскими юристами в рамках их пересмотра в судебном порядке.

This article is devoted to tendencies of administrative legislation development in Great Britain in the sphere of administrative procedure. The author notes the optimization and harmonization of administrative procedure rules, and considers peculiarities of jurisdiction activity of the UK Administrative Court. The author proves the existence of a formal approach in the UK requirements to the administrative legal procedures. Also the paper reveals the specifics of interpretation of administrative acts’ revision by British lawyers.
