Abstract

In article problems of a parity of positions of the Civil code of the Russian Federation about the general bases of cancellation of the civil-law contract and on the bases of prescheduled cancellation of the contract of rent reveal. It is displayed that interpretation of essential infringement of treaty provisions, are erroneous as such interpretation of norms generates necessity in each specific case cancellation of the contract of rent on the bases provided by the item of item 619, 620 Civil code the Russian Federation, to prove that such bases are essential infringement of treaty provisions.

В статье раскрываются проблемы со-отношения положений Гражданского кодекса РФ об общих основания расторжения гражданско-правового договора и об основаниях досрочного расторжения договора аренды. Отображено, что толкование су-щественного нарушения условий договора, являются ошибочными, поскольку такое толкование норм по-рождает необходимость в каждом конкретном слу-чае расторжения договора аренды по основаниям, предусмотренным ст.ст. 619, 620 ГК РФ, доказы-вать, что такие основания являются существенным нарушением условий договора.
