История возникновения и становления института межотраслевой преюдиции в уголовном процессе России

Abstract

В статье рассматривается историческое развитие правового института межотраслевой преюдиции в уголовном процессе России. Проведен анализ законодательства, регламентирующего положения о преюдициальном значении решений, принятых в рамках гражданского судопроизводства, при рассмотрении уголовных дел в дореволюционный и постреволюционный периоды.

The paper considers history of establishment of a legal institution of inter-branch prejudice in Russian criminal procedure. The study carries out analysis of legal acts regulating prejudicial significance of decisions in civil proceedings, in criminal case’ trial both in pre-revolutionary and post-revolutionary periods.
