Участие потерпевшего в поисковой деятельности следователя

Abstract

The article discusses specific features of victim's participation in the search activities of an investigator, namely, in the procedures of crime scene examination, search, seizure. The utmost importance of incident site examination is justified. The author discusses the features of this examination in the investigation of certain categories of criminal cases, which necessitates involvement of the victim (rape, theft, robbery, burglary, bodily injury). The author notes the inappropriateness of the victim's participation in the search and seizure of the suspect.

В статье рассматриваются особенности участия потерпевшего в поисковой деятельности следователя, а именно в процедурах осмотра места происшествия, обыска, выемки. Обоснована исключительная важность осмотра места происшествия. Представлены особенности проведения данного осмотра при расследовании определенных категорий уголовных дел, которые предполагают необходимым привлечение потерпевшего (изнасилование, кража, грабеж, разбой, причинение вреда здоровью). Отмечена нецелесообразность участия потерпевшего при произведении обыска и выемки у подозреваемого.
