Определение недвижимого имущества: проблемы теории и практики

Abstract

Введение. Казалось бы, законодательное определение недвижимого имущества, закрепленное в ст. 130 ГК РФ, просто и понятно. В нем законодатель указал критерии, по которым его можно выявить, и обозначил краткий перечень недвижимости. Однако разобравшись подробнее в теории, возникает масса вопросов, да еще и на практике постоянно выносятся противоречивые решения. Теоретический анализ. В данной статье анализируются доктринальные и практические проблемы, возникающие при толковании и отнесении того или иного имущества к недвижимому, и предлагаются некоторые варианты выхода из сложившейся ситуации. В данном исследовании используются такие методы, как анализ, синтез, сравнительно- правовой. Выводы. Результатом исследования является выявление необходимости пересмотра действующего законодательного определения недвижимого имущества.

Introduction. It would seem that the legislative definition of immovable property, enshrined in Art. 130 of the Civil Code, simple and clear. It legislator have criteria by which it can be identified and outlined a short list of real estate. However, you understand in more detail in theory, a lot of questions, and even in practice very often taken out different solutions. Theoretical analysis. This article examines the doctrinal and practical problems arising in the interpretation and the designation of a property to the real estate, and offers some options out of the situation. In this study, using methods such as analysis, synthesis, comparativelegal. Conclutions. The result of the study is to identify the need to revise the current legislative definition of immovable property.
