Некоторые сравнительно-правовые аспекты англо-американской и романо-германской концепций авторского права

Abstract

The comparative-right analyses of Anglo-American (copyright) and Romance-German (droit d'auteur) conception of copyright law is given in the article. The phases of formation and the factors that influence the conceptions are viewed. The differences that are new for Russian jurisprudence between conception of copyright and droit d'auteur are showed.

Проводится сравнительно-правовой анализ англо-американской (copyright) и романо-германской (droit d'auteur) концепций авторского права. Рассматриваются этапы становления этих концепций, а также исследуются факторы, повлиявшие на их облик. Выявляются новые для российской юриспруденции различия между концепциями copyright и droit d'auteur.
