К вопросу о квалификации злостных нарушений режима в исправительных учреждениях

Abstract

The article covers the legislative provisions related to the legal assessment of violations of the regime, which are committed by convicts in the process of their service of term in the correctional institutions. We identify the gaps in the criminal-executive code defining the types of persistent violations of the established order of execution and punishment, and propose a new wording of the legal norms regulating these issues.

Рассматриваются законодательные положения, связанные с правовой оценкой нарушений режима, совершаемых осужденными в процессе отбывания лишения свободы в исправительных учреждениях. Выявляются пробелы в Уголовно-исполнительном кодексе, определяющем виды злостных нарушений установленного порядка исполнения и отбывания наказания, и предлагается новая редакция правовых норм, регулирующих данные вопросы.
