Актуальные вопросы судебно-арбитражной практики в сфере недропользования

Abstract

В публикации авторами рассмотрены некоторые вопросы судебно-арбитражной практики, являющиеся актуальными в настоящее время. Основной акцент в рамках настоящей статьи сделан на анализе и систематизации подходов арбитражных судов к применению норм современного горного законодательства, определяющих правовую природу отношений, возникающих между пользователями и государственными органами, характер разовых платежей за пользование недрами, практику применения положений законодательства, определяющего механизм предоставления недр в пользование, переход и досрочное прекращение права пользования недрами.

The authors consider some issues of court practice which are of interest for oil industry. The main emphasis is made on the analysis and systematization of arbitration (state arbitrazh) courts approaches to the application of current mining legislation rules specifying the legal nature of relations between subsoil users and state authorities, the character of onetime payments for subsoil use, as well as application practice of legislative provisions determining the procedure for provision of the subsoil into use, transfer and early termination of subsoil use rights.
