Abstract

The article reflects the problem of ambiguity and confusion reflection in the law and the interpretation of the Supreme Court of the RF performance of the functions of authority representative as subject of corruption crimes officials. States that on the basis of the ambiguous wording of the law is under construction litigation, actually right, but paradoxically not corresponding to the explanations of the higher court instance the Supreme Court of the Russian Federation.

Статья отражает проблему неясности и неточности отражения в законе и толковании Верховного Суда РФ исполнения функций представителя власти как признака субъекта коррупционных преступлений должностного лица. Указывается, что на основе неоднозначных формулировок закона строится судебная практика, верная по сути, но парадоксально не соответствующая разъяснениям высшей судебной инстанции -постановлению Пленума Верховного Суда РФ.
