Региональные законы о делегировании полномочий: правовая экспертиза

Abstract

В связи с реформой системы здравоохранения актуальными становятся вопросы взаимодействия органов государственной власти и местного самоуправления. Одной из основных форм взаимодействия является наделение органов местного самоуправления отдельными государственными полномочиями. Анализ регионального законодательства указывает на наличие пробелов в правовом регулировании делегирования государственных полномочий, которые могут затруднить реализацию гарантированного права человека на охрану здоровья и медицинскую помощь.

The questions of interaction the bodies of state government and the local self-government bodies become acute, in the order ofhealth care reformation. A delegations state power is one of the main forms of interaction between state and local powers. Nowadays there are some legal gaps in the region legislation, which may produce difficulties in realization guaranteed constitutional right of citizen to the health protection and medical assistance.
