Вопросы развития института ответственности международных организаций

Abstract

Одной из основных организационно-правовых форм межгосударственного сотрудничества являются международные межправительственные организации, число и роль которых в современном глобализирующемся мире постоянно растёт. Особенно важное значение приобретает вопрос о том, на каких условиях такие субъекты международного права как международные организации должны нести ответственность за совершённые ими нарушения международно-правовых норм, и какие правила будут действовать в отношении государств-членов или организаций-членов при призвании их к ответственности в связи с деянием международной организации. Целью настоящей работы является анализ института ответственности международных организаций на основе положений, разработанных Комиссией международного права ООН, практики международных судебных учреждений и доктринальных исследований в этой области. Делается вывод о необходимости дальнейшей кодификации и прогрессивном развитии института ответственности международных организаций

International intergovernmental organizations represent one of the main organizational legal forms of interstate cooperation. Their number is increasing and the role is expanding. The terms on which these subjects of international law should bear responsibility for violations of international legal norms and what regulations are applicable in this case become crucial issues. The article analyzes the institution of international organizations responsibility on the basis of the regulations developed by the International Law Commission, international judicial institutions practice and recent research in this area.
