Abstract

The article is devoted to the problem of defining and implementing confidentiality of defense counsel activity. The question of governing the relations between a defender and a defendant within international acts is considered. The concept of confidentiality and categories of confidential information and information that forms legal professional privilege are analyzed in accordance with federal legislation and international law. It is established that the guarantee of legal professional privilege is aimed to provide information interchange confidentiality between a defender and a defendant, i.e. communication secret (oral, in written form or by phone, etc.); confidentiality of storing the information by a defender; prohibition to transfer the information about the defendant to other people and prohibition to demand such information from the defender. It is offered to consider the rule on confidentiality as a rule aimed to provide confidentiality of negotiations, meetings between a defender and a defendant, and storage of the information about the defendant. This rule should also guarantee the impossibility to get any information by strangers to the litigation (including law enforcement officers) without knowledge and agreement of the defendant and his or her defender.

Статья посвящена проблеме определения понятия и реализации конфиденциальности в деятельности адвоката-защитника. Уделяется внимание регулированию вопроса конфиденциальности отношений между адвокатом-защитником и его подзащитным в международных нормативных актах. Анализируются понятие «конфиденциальность», категории «сведения конфиденциального характера», а также «сведения, составляющие адвокатскую тайну» в соответствии с федеральным законодательством и международными нормами. Определено, что гарантии адвокатской тайны имеют своей целью обеспечение конфиденциальности обмена информацией между доверителем и адвокатом, то есть тайны коммуникации (устной, письменной, телефонных переговоров и т.д.); конфиденциальности хранения информации у адвоката; запрет передавать информацию о доверителе третьим лицам и запрет третьим лицам требовать от адвоката предоставить такую информацию. Предлагается рассматривать правило конфиденциальности как обеспечение переговоров, встреч адвоката с подзащитным, а также хранение информации в отношении последнего, которое не позволяет получить какие-либо сведения посторонним лицам (в том числе, в первую очередь, сотрудникам правоохранительных органов) без ведома и согласия на то подзащитного (доверителя) и его адвоката.
