Імперативний мандат: окремі питання конституційної теорії та практики в сучасних умовах

Abstract

Article is devoted to the distinct issues of constitutional theory and practice relating to imperative mandate concept in contemporary conditions. The aim of the article is to highlight the general theoretical ideas of imperative mandate concept in Ukraine and particular foreign states by analyzing the constitutional and legal thought and generalization of the experience of parliamentary activities. In the article the question of choosing the optimal model of parliamentary mandate in Ukraine is raised. The problem is studied through the prism of the primary problems of democracy, regarding to the nature of parliamentarians and voters relations and communications. The process of creating and developing of imperative mandate concept is clarified in this article, as well as the concept’s fundamental elements are explored. The influence of imperative mandate doctrine on contemporary constitutional practice in Ukraine and foreign states is analyzed.

Cтаття присвячена окремим питанням конституційної теорії та практики, що стосуються інституту імперативного мандату в сучасних умовах. Метою статті є висвітлення загальнотеоретичних ідей інституту імперативного мандату в Україні та окремих зарубіжних країнах шляхом аналізу конституційно-правової думки та узагальненого практичного досвіду депутатської діяльності. В представленій статті піднімається питання вибору оптимальної моделі депутатського мандату в Україні через призму ключової проблеми народовладдя, що стосується характеру зв’язку і взаємовідносин виборців із депутатами. В роботі висвітлюється процес становлення та розвитку концепції імперативного мандату, проводиться загальнотеоретичний аналіз головних його елементів. Також в ній проаналізовано вплив доктрини імперативного мандату на сучасну конституційну практику в Україні та зарубіжних країнах.
