Правовая природа разумного срока уголовного судопроизводства

Abstract

The article discusses the reasonable time, timeliness, rapidity in criminal proceedings. The author investigates the essence of the reasonable time in criminal proceedings of Russia. The author notes non-identity of such categories as duration of the legal proceedings prescribed by the law and reasonable time of the legal proceedings. It has been established that the concept of "reasonable time" is an evaluative and can be interpreted depending on the circumstances of the particular case. The author suggests an original definition of the reasonable time.

В статье рассматриваются понятия «разумный срок», «своевременность», «быстрота» в сфере уголовного судопроизводства, изучается сущность разумного срока в уголовном судопроизводстве России. Отмечена нетождественность таких категорий, как сроки рассмотрения дела, установленные законом, и разумные сроки рассмотрения дела. Установлено, что понятие «разумный срок» является оценочным и может трактоваться в зависимости от обстоятельств конкретного дела. Представлено авторское определение понятия «разумный срок».
