Особенности процедуры внесения изменений и дополнений в Конституцию Российской Федерации

Abstract

The article is devoted to research of some problem questions of procedure of changes of the Constitution of the Russian Federation. The author pays attention to an admissibility of direct application of some norms of the constitution concerning changes of chapters 1, 2 and 9 Constitutions of the Russian Federation. However for the lack of the Federal constitutional law on the Constitutional Assembly completely to realize the given mechanism it is not obviously possible. The theory and practice of changes in other chapters of the Constitution of the Russian Federation is investigated. A number of measures on perfection of the legislation and judiciary practice are offered.

Статья посвящена исследованию ряда проблемных вопросов процедуры внесения поправок в Конституцию Российской Федерации. Автор обращает внимание на допустимость прямого применения отдельных норм Основного закона страны в отношении механизма внесения поправок в главы 1, 2 и 9 Конституции РФ. Однако в отсутствие Федерального конституционного закона о Конституционном Собрании полностью реализовать данный механизм не представляется возможным. Исследуется теория и практика внесения поправок в другие главы Конституции РФ. Предлагается ряд мер по совершенствованию законодательства и правоприменительной практики.
