Abstract

Статья посвящена проблемам противодействия незаконному уголовному преследованию бизнеса, в том числе средствами и методами современной криминалистики. В работе отмечены новейшие инициативы по внесению изменений в статью 299 Уголовного кодекса Российской Федерации в части ужесточения ответственности за незаконное уголовное преследование предпринимателей. Сформулированы основные задачи криминалистики, направленные на познание преступной деятельности, состоящей в незаконном привлечении к уголовной ответственности субъектов предпринимательской деятельности, а также разработке системы методических рекомендаций по раскрытию и расследованию таких преступлений.

The article deals with the problems of counteraction to illegal criminal prosecution of business, including the means and methods of modern criminology. The work marked the latest initiative to amend article 299 of the Criminal Code of the Russian Federation in the part of tightening responsibility for the illegal criminal prosecution of businessmen. The main tasks of criminology, aimed at knowledge of criminal activity consisting in the illegal criminal prosecution of business entities, as well as the development of a system of guidelines for the detection and investigation of such crimes.
