Борьба с незаконным использованием товарных знаков: актуальные проблемы

Abstract

Автором статьи рассматриваются вопросы борьбы с оборотом контрафактной продукции, основные правовые способы защиты прав добросовестных производителей и законных правообладателей: подача иска и преследование нарушителя путем возбуждения уголовного дела или дела об административных правонарушениях. Делается вывод о том, что достижение успехов в борьбе с контрафактной продукцией возможно только при наличии единой методики по расследованию преступлений, связанных с нарушением права на товарный знак, а также при активном участии самого правообладателя.

The author considers the fight against trafficking in counterfeit goods, the main legal ways to protect the rights of bona fide producers and legal owners: filing of the claim and prosecution of wrongdoing by a criminal case or cases of administrative violations. The conclusion is that achieving success in the fight against counterfeit goods is only possible if there is a common technique to investigate crimes involving violations of trademark rights, as well as with the active participation of the copyright holder.
