The author of the article estimates the implementation of the first stage of the conception of the development of the penal system of the Russian Federation. The author analyzes the main provisions of the draft of Federal Law on probation in the Russian Federation and the system of bodies and organizations exercising it. The author suggests to rename the probation body to the service of control and social adaptation, to clarify the name of the persons who are the subjects to control, social adaptation and rehabilitation. The author refers to the experience of similar organizations in foreign countries and former USSR republics. The initiative to make a «social report» at the pre-trial stage of probation is critically evaluated.

В статье дается оценка реализации первого этапа Концепции развития уголовно-исполнительной системы Российской Федерации. Анализируются основные положения проекта Федерального закона «О пробации в Российской Федерации и системе органов и организаций, ее осуществляющих». Предлагается переименовать орган пробации в службу по контролю и социальной адаптации, внести ясность в наименование лиц, в отношении которых применяются меры по контролю, социальной адаптации и ресоциализации. Приводится зарубежный опыт учреждения аналогичных служб, в том числе в республиках бывшего Советского Союза. Критически оценивается инициатива по составлению «социального доклада» на досудебной стадии пробации.
