ТРЕБОВАНИЯ К ХОДАТАЙСТВАМ ЧАСТНЫХ ЛИЦ В ДОСУДЕБНОМ ПРОИЗВОДСТВЕ КАК НЕОБХОДИМОЕ УСЛОВИЕ ДОБРОСОВЕСТНОЙ РЕАЛИЗАЦИИ ПРАВ УЧАСТНИКОВ УГОЛОВНОГО СУДОПРОИЗВОДСТВА

ТРЕБОВАНИЯ К ХОДАТАЙСТВАМ ЧАСТНЫХ ЛИЦ В ДОСУДЕБНОМ ПРОИЗВОДСТВЕ КАК НЕОБХОДИМОЕ УСЛОВИЕ ДОБРОСОВЕСТНОЙ РЕАЛИЗАЦИИ ПРАВ УЧАСТНИКОВ УГОЛОВНОГО СУДОПРОИЗВОДСТВА

Abstract

The subject of the article is legal relations that arise when individuals make petitions for the protection of their rights and legal interests in the pre-trial stages of criminal proceedings, and officials and state bodies consider and resolve such petitions. The relevance of the issue is due to the lack of the legal regulation of the order of the disposition of the right to make petitions, and to the possible emergence of abusive behavior. The author sets the following objectives: 1) formulation of the concept of petition; 2) classification of petitions by the stage of the criminal proceedings; 3) characterization of qualitative features of petitions; 4) determination of the forms of abuse of the right to make petitions depending on defects of form and content of petitions; 5) development of measures for prevention and suppression of the abuse of the right to make petitions. Having used dialectical, formal logical, logical-legal methods of knowledge, the author analyzed the following requirements for the realization of the right to make a petition: validity and motivation; relevance of statements contained in the petition; possibility to make an analogous petition; terms for making a petition. The article deals with each of these requirements from the perspective of the possible abuse of subjective right; identifies forms of such a behavior and measures for its prevention and suppression. The article notes the need for the regulation of the procedure for resolving petitions. The author states that the lack of clear legislative requirements causes abuse of discretion by officials who make decisions about approval or rejection of the petition. In this regard, having analyzed the results of the research of jurisprudence in Tomsk and Krasnoyarsk, the author cites statistics about types and motives of decisions of officials. The article notes the prevalence of such phenomena as unmotivated refusals. The result of the research is the development of the mechanism of realization of the right to make petitions, which would ensure a balance between the applicant's interests, the interests of other participants in criminal proceedings and the interests of justice. The author enumerates the basic elements of this mechanism and states that its cumulative entrenchment will ensure conscientious realization of the right to make petitions and lawful execution of powers by officials.

Указывается, что правовая неопределенность, наличие пробелов в законодательном регулировании порядка распоряжения правом на заявление ходатайств могут стать предпосылкой различных форм злоупотребления. На основе анализа литературы и судебной практики дается характеристика способов злоупотребления правом на обращение с ходатайством, а также обосновывается необходимость закрепления требований к содержанию, его качественным признакам и механизму разрешения ходатайств частных лиц.
