Abstract

Анализируется уголовное законодательство Российской Федерации и Федеративной Республики Германии, исследуется методика оптимальной реализации категории «эффективность» в уголовном правотворчестве. Вносятся обоснованные предложения по совершенствованию законодательства Российской Федерации в контексте повышения эффективности отдельных видов наказаний.

The domestic and German criminal law is studied, the optimal method of implementing the category of “efficiency” in the criminal law-making is analyzed. The reasonable suggestions to improve the legislation of the Russian Federation in the context of improving the effectiveness of individual penalties are made.
