История развития и становления института частного обвинения в уголовном процессе России, проблемы частного обвинения и пути решения

Abstract

In a scientific article, the author explores the development of the private prosecution in criminal procedure of Russia from the earliest times to the present. The author concludes that a private prosecution is fundamental and a basic institution of criminal proceedings in Russia, which in the period of formation and development has changed and evolved into a public accusation, maintaining a private launch. The author examines the private prosecution as a "criminal action" and suggested, in view of the historical experience of Russia, making changes to the code of criminal procedure of the Russian Federation.

Исследуется развитие представлений о частном обвинении в уголовном процессе России с древнейших времен до настоящего времени. Делается вывод о том, что частное обвинение является основополагающим и базовым институтом уголовного процесса России, который в период становления и развития претерпел изменения и трансформировался в публичное обвинение, сохранив в себе частные начала. Автор рассматривает частное обвинение как уголовный иск и предлагает, с учётом исторического опыта России, внесение изменений в Уголовно-процессуальный кодекс РФ.
