К вопросу о соотношении судебного контроля и иных форм контрольно-надзорной деятельности в досудебном производстве по уголовным делам

Abstract

Рассматриваются вопросы, касающиеся сущности и содержания функции судебного контроля в уголовном судопроизводстве, проводится сравнительный анализ его соотношения с прокурорским надзором и ведомственным контролем в стадиях возбуждения уголовного дела и предварительного расследования. Определяются критерии разграничения рассматриваемых процессуальных функций, исследуются контрольно-надзорные полномочия суда, прокурора и руководителя следственного органа, на основании чего делается вывод о том, что они не исключают, а взаимодополняют друг друга.

Theoretical researches of the court control in the procedural criminal law have been carried out for more than several decades, but still there is no unified attitude to the understanding of the essence, subject structure and the meaning of this function of the court and its collaboration with the other forms of control activity. We suppose that the court control should be considered as one of the main areas of the procedural criminal activity, i.e. procedural criminal function.
