This article investigates the Appellate Body as a permanent quasi-judicial agency within the framework of the WTO: the history of its establishment and the gradual growth to reach foreground in such capacity. During a short period of time the Appellate Body has grown from a young international agency for dispute settlement into a highly reputable judicial authority ensuring stability and predictability in the international trade system. This article covers a number of important theoretical and practical aspects related to the current activities of the Appellate Body: the procedure for consideration of appeal petitions, an elaborate holistic approach to interpretation of the provisions of the WTO agreements, the achieved coherence and consistency in its resolutions. The article also reviews the issue of borrowing the term «acquis» by the Appellate Body from the law of the European Union.

В настоящей статье исследуется Апелляционный орган как постоянно действующий квазисудебный орган в рамках ВТО: история его создания и постепенный рост до достижения видного положения в таком качестве. За короткий промежуток времени Апелляционный орган превратился из молодого международного органа по разрешению споров в уважаемый судебный орган с высокой репутацией, обеспечивающий стабильность и предсказуемость в международной торговой системе. В настоящей статье затрагивается ряд важных теоретических и практических аспектов, связанных с текущей деятельностью Апелляционного органа: процедура рассмотрения апелляционных жалоб, разработанный комплексный подход к толкованию положений Соглашений ВТО, обеспеченная согласованность и последовательность в его решениях. Также затрагивается вопрос заимствования термина «acquis» Апелляционным органом из права Европейского союза.
